CheckStream provides a software service that allows users to scan and process physical checks, extract relevant data using artificial intelligence, and integrate this data with third-party accounting software such as QuickBooks to record payments.

3. User Accounts

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User Responsibilities and Conduct

You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or impair anyone else's use of it. Prohibited activities include, but are not limited to:

• Processing fraudulent, stolen, or altered checks.
• Uploading malicious software or code.
• Attempting to gain unauthorized access to our systems or user accounts.
• Using the Service to violate any applicable local, state, national, or international law.

You are solely responsible for the accuracy and legality of all data, including check images, that you upload to the Service.

5. Fees and Payment

Access to certain features of the Service may require payment of fees. All fees are specified in your service agreement or on our pricing page. We use a third-party payment processor, Stripe, to handle all payments. By providing a payment method, you expressly authorize us to charge the applicable fees on a recurring basis. All payments are non-refundable except as required by law.

The Service relies on integrations with third-party services, including QuickBooks, Stripe, and various AI service providers. Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the performance, availability, or security of any third-party services.

7. Intellectual Property

We own all rights, title, and interest in and to the Service, including all related software, logos, and trademarks. You own all rights, title, and interest in and to the data and content you submit to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process Your Content solely for the purpose of providing the Service to you.

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHECKSTREAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
